Read this document carefully. It affects your legal rights, including your right to sue.
This agreement covers skateboarding instruction and related activities provided by Skate 05 and its instructors at public skateparks in San Luis Obispo County, California, including the SLO Skate Park in San Luis Obispo, the South County Skate Park in Grover Beach, and the skatepark at Nipomo Community Park, together with any other location where a lesson takes place. "Skate 05" below includes its owners, instructors, employees, volunteers, and agents.
I understand that skateboarding is a hazardous recreational activity that carries risks which cannot be eliminated regardless of the care taken. These risks include:
I have read this list, I understand that it is not exhaustive, and I knowingly and voluntarily assume all risks of participation, both known and unknown, on behalf of myself and the skater named above. initial
I understand that a helmet is required at every lesson and that the parks where lessons take place require protective gear. I agree that the skater will wear a properly fitted helmet at all times during a lesson, and I understand that pads are strongly recommended. I understand that protective equipment reduces the risk of injury without eliminating it. initial
I confirm that the skater is physically able to take part in skateboarding instruction, and that I have disclosed above any medical condition, allergy, or medication that Skate 05 should know about.
In consideration of being permitted to take part, I, on behalf of myself, the skater, and our heirs, executors, administrators, and assigns, release, waive, and discharge Skate 05 from any and all claims, demands, causes of action, and liability for personal injury, death, or property damage arising out of or connected with participation in a lesson, including claims arising from the ordinary negligence of Skate 05. I agree not to sue Skate 05 for any such claim.
This release does not apply to gross negligence, recklessness, or wilful or intentional misconduct, and it does not release any liability that cannot be released under California law. initial
I agree to indemnify, defend, and hold Skate 05 harmless from any claim, loss, liability, damage, or cost, including reasonable legal fees, brought by or on behalf of the skater or any third party arising out of the skater's participation, except to the extent caused by the gross negligence or wilful misconduct of Skate 05.
If I cannot be reached promptly, I authorize Skate 05 to arrange emergency medical care for the skater, and I accept financial responsibility for that care. I confirm that the skater is covered by health insurance, or that I accept responsibility for medical costs if not.
I understand that lessons take place at unsupervised public skateparks, that Skate 05 is responsible for the skater only during the scheduled lesson, and that I am responsible for the skater before and after it. I agree to arrive on time for pick-up.
I confirm that I am eighteen years of age or older and that I am the parent or legal guardian of the skater named above, with authority to sign this agreement on the skater's behalf.
This agreement is governed by the laws of the State of California, and any dispute will be brought in the state or federal courts serving San Luis Obispo County. If any part of this agreement is held unenforceable, the remainder stays in full effect. This agreement applies to every lesson taken with Skate 05 until I revoke it in writing.
I have read this agreement, I understand that I am giving up substantial legal rights, and I sign it freely and voluntarily.
